- Scope of Application
- These General Terms and Conditions of Sale and Use ("GTC") of ATME SPORTS TRADING L.L.C, with operating office at Dubai, U.A.E. (hereinafter referred to as "ANTA”) shall apply to all contracts concluded with buyers, irrespective of whether the buyer is a consumer or a trader (hereinafter referred to as "Customer”) and ANTA relating to all products presented in ANTA's online shop available under ae ("Webshop"). Deviating terms and conditions of the Customer shall only be accepted if ANTA has agreed to their applicability in writing.
- A consumer pursuant is any natural person concluding a legal transaction for a purpose attributed neither to a mainly commercial nor a self-employed occupational activity. A trader is any natural or legal person or partnership with legal capacity acting in the performance of a commercial or self-employed occupational activity when concluding a legal transaction.
- Conclusion of the Contract
- The product descriptions in the Webshop do not constitute binding offers on the part of ANTA.
- The Customer may submit an offer via the online order form integrated into the Webshop. By placing the selected products in the virtual shopping cart and passing through the ordering process by clicking the button titled "buy now", the Customer finalises the order process and submits a legally binding offer to purchase the products contained in the shopping cart. The offer can only be sent and transmitted if the Customer confirms acceptance of these GTC by ticking the corresponding checkbox.
- If the Customer chooses prepayment, the contract is concluded once the Customer receives the automatic confirmation. For all other payment methods, the contract is concluded as soon as the Customer receives the dispatch notification or dispatch confirmation sent by email; at the latest, however, upon receipt of the products.
- ANTA sends the Customer an automatic acknowledgment of receipt by email, in which the Customer's ordered products are listed. This automatic acknowledgment of receipt does not constitute acceptance of the Customer's order. In an email or at the latest upon delivery of the products, ANTA will send the full contract text (consisting of the order, GTC and order confirmation) to the customer on a permanent data carrier (email or printout).
- Prior to submitting a binding order via the online order form in the Webshop, the Customer may recognize and correct input errors, until clicking the button which submits the order. The contract text will be stored in compliance with data protection regulations and can be found by the Customer via the password-protected customer account by entering the respective login information, provided that the Customer has created a customer account in the Webshop prior to submitting an order. The contract is concluded in English.
- If ANTA is unable to supply the Customer with a Product, including where the Product is out of stock, no longer available, subject to delivery restrictions, or where there has been an error in the price, description or other information displayed on the Website, ANTA will inform the Customer as soon as reasonably practicable by email or other contact details provided by the Customer, and ANTA may cancel or decline the relevant order. If the Customer has already paid for the affected Product, ANTA will refund the amount paid for that Product, together with any corresponding delivery charges paid in respect of the affected order or affected part of the order, using the original payment method, and ANTA shall have no further liability to the Customer except as required under applicable law.
- The Customer acknowledges and agrees that ANTA may verify the authenticity, accuracy and sufficiency of the information provided by the Customer in connection with any order, including billing, delivery and contact details. Where such information cannot be verified automatically, ANTA may contact the Customer and/or, where appropriate and lawfully permitted, the issuer of the Customer’s debit card, credit card or other payment method, for the purposes of confirming the Customer’s identity, payment details and/or intention to place the order.
- Products made available through the Website are intended for personal, non-commercial use only. The purchase of Products for resale, distribution, export trading, or other commercial purposes without ANTA’s prior written consent is strictly prohibited. ANTA reserves the right to reject or cancel any order where it reasonably believes that the Products are being purchased for resale or other unauthorised commercial purposes.
- By placing an order or making a payment through the Website, the Customer represents and warrants that he or she is legally capable of entering into a binding contract under applicable law. The Customer further represents and warrants that all information provided for the purpose of processing the order and payment is true, accurate, current and complete, and that the Customer is duly authorised to use the debit card, credit card or other payment method submitted. ANTA reserves the right to verify the authenticity of the payment information and the authority to use the selected payment method. If ANTA is unable to verify the information provided, or reasonably suspects fraud, misuse, unauthorised use, or any other unlawful activity, ANTA may suspend, reject or cancel the order at any stage. In the event that ANTA cancels an order after payment has been received, ANTA will refund the amount actually paid using the original payment method, subject to any deductions or delays required by applicable law, banking procedures, or fraud prevention requirements.
- The Customer acknowledges and agrees that ANTA may carry out compliance, fraud prevention, security and sanctions screening checks in relation to the Customer, the order, the payment method, the delivery details and any other information provided in connection with the transaction, to the extent permitted by applicable law. Such checks are designed to prevent ANTA from processing transactions that may violate applicable laws, regulations, sanctions, embargoes, export control restrictions, anti-money laundering requirements, or other legal or regulatory obligations in the jurisdictions in which ANTA operates. ANTA reserves the right to refuse, suspend or cancel any order where it reasonably determines that processing the transaction may expose ANTA to legal, regulatory or compliance risk.
- Prices and Payment
- Unless otherwise stated in ANTA’s product description, the prices indicated are total prices and include applicable UAE value added tax (VAT), where applicable.
However, please note that where products are shipped on a cross-border basis or are subject to import clearance into the United Arab Emirates, additional charges may apply, including customs duties, import VAT, clearance fees, or other charges imposed by the relevant authorities. Unless expressly stated otherwise, such charges are not included in the purchase price and shall be borne by the Customer. ANTA recommends that Customers check with the relevant customs or tax authorities in their jurisdiction regarding any potential customs duties, VAT, or other local charges before placing an order. Delivery costs, where applicable, will be indicated separately in the respective product description and in the order form prior to its submission.
- Payment can be made using one of the methods mentioned in the Webshop. The actual payment methods available at the time of ordering may vary and you will be informed of the specific payment methods offered before placing the order. The methods include:
- Tabby,
- direct/ debit card,
- credit card.
Any refunds will be made automatically in the same way as you originally paid.
- By placing an order through the Website, the Customer authorises ANTA to process the relevant payment transaction, including charging the Customer’s selected payment method for the total amount payable for the order, processing any approved refund, and making any necessary payment adjustment in accordance with these GTC and applicable law.
The Customer acknowledges and agrees that ANTA may, at any time, request such personal, payment, or other information as ANTA reasonably considers necessary to verify the Customer’s identity, the authenticity of the order, and the Customer’s authority to use the selected payment method.
- Shipment and Delivery Conditions
- Products are generally delivered on dispatch route and to the delivery address indicated by the Customer in the order form, unless agreed otherwise. During the processing of the transaction, the delivery address indicated in ANTA’s order processing is decisive.
- Delivery is only available to Customers whose habitual place of residence or billing address is in the United Arab Emirates and who can provide a delivery address within the United Arab Emirates.
- ANTA is free to deliver the products in partial shipments.
- Membership
- You can become a member of the ANTA community by submitting your email and setting up a password. This requires prior registration by clicking on the button "Register now"
- During the registration, you must tick the box next to the sentence ‘I agree to the GTC’. By ticking the box, you confirm that you agree to comply with these GTC which can be accessed through the provided link and downloaded.
- During the registration process, you must verify your email address. To do this, we will send you an email with a confirmation code. Without verification, the registration process cannot be continued. During and after you have completed the registration process, you can change the information you have entered in your personal account at any time.
- As we provide the Webshop voluntarily and free of charge, we are entitled to refuse to create an account in individual cases without giving any reasons.
- Return Policy
- Customers may return an item for a full refund to the original payment method within seven (7) calendar days from the date of delivery, provided that the item is unused, unwashed, unaltered, in saleable and original condition, and returned with all original packaging, tags, labels and accessories intact. Where applicable, protective seals, hygiene strips or similar protective features must remain unbroken. Proof of purchase, such as the order confirmation, tax invoice or receipt, is required for all return and repair requests.
Please note that ANTA does not offer a direct exchange facility at this time. If you require a different size, colour, or style, please place a return request for the original item in accordance with this GTC and then create a new order for the replacement item.
In addition, within ninety (90) days from the date of delivery, ANTA may provide one free repair where repair is reasonably feasible and the issue has not been caused by misuse, abnormal wear and tear, accidental damage, improper care or handling contrary to product instructions.
Once a return label has been generated, the item must be dispatched within five (5) days. Unless the item is defective or incorrectly delivered, the cost and risk of return shipment shall be borne by the Customer and may be deducted from the refund.
If a product is defective, unsafe, damaged on delivery, or materially not as described, ANTA will handle the matter in accordance with applicable UAE consumer protection law. Depending on the circumstances and as required by law, the available remedy may include repair, replacement, return, refund, or other appropriate corrective action. Nothing in this Policy is intended to limit any mandatory consumer rights available under applicable law.
- For health, safety and product integrity reasons, certain items cannot be returned unless they are defective, unsafe, or not as described. These items include underwear, swimwear, socks, lingerie, sports bras, face masks, items with broken hygiene seals, gift cards, and customised or personalised products. Products marked as “Final Sale” or sold at a discount of 50% or more are not eligible for refund unless they are defective, unsafe, or not as described. Where an order includes a free gift or promotional item, it will not be eligible for refund unless required by law. ANTA may require any free gift to be returned where a refund is processed.
- To request a return or repair, customers must contact ANTA through the customer service channels indicated on the Website and provide the relevant order details and proof of purchase. ANTA may request photographs, a description of the issue, or other information reasonably necessary to assess the request. Returned items must be sent back in accordance with ANTA’s instructions, and ANTA reserves the right to inspect the returned item before approving the requested remedy.
- Approved refunds will be processed to the original payment method used for the purchase. ANTA will initiate the refund within its standard processing period after inspection and approval, although the time for the refunded amount to appear in the customer’s account may vary depending on the relevant payment provider, card issuer, or bank. Delivery charges, shipping fees, cash-on-delivery fees, customs charges and similar fees are non-refundable unless the return is due to a defective, incorrect, unsafe, or not-as-described product, or unless otherwise required by applicable law.
- This Policy applies only to products purchased through ANTA’s UAE online store, unless ANTA expressly states otherwise. Products purchased from ANTA physical stores are subject to the applicable in-store returns and exchanges policy. Products purchased from authorised distributors, resellers, marketplaces or third-party platforms may be subject to the returns and refund rules of the relevant seller or platform, except to the extent mandatory UAE consumer rights apply.
- ANTA reserves the right to reject returns or repairs that do not comply with this Policy, that appear fraudulent, abusive, or made in bad faith, or where the returned products are damaged due to misuse, improper handling, or use inconsistent with product instructions, without prejudice to any mandatory legal rights of the customer.
- For any questions regarding returns or repairs, customers may contact ANTA Customer Service through the contact details provided on the Website.
- Reservation of Ownership
ANTA retains ownership to the delivered products, until the purchase price has been paid in full.
- Product Warranties and Liability
- If a Product purchased through the Website is defective, damaged on delivery, unsafe, or not in conformity with its description or agreed specifications, the Customer should contact ANTA Customer Service using the contact details provided on the Website. ANTA will review the issue and, where applicable, provide an appropriate remedy in accordance with these GTC and applicable law, which may include repair, replacement, return, refund, or other corrective action as required.
- ANTA makes reasonable efforts to ensure that product descriptions, images, sizing information, specifications and other content displayed on the Website are accurate and up to date. However, minor variations may occur, including due to screen display, photographic representation, manufacturing updates, or other technical reasons. Nothing in these GTC excludes or limits ANTA’s responsibility for supplying Products that conform to the description presented at the time of purchase or for any obligations that cannot be excluded under applicable law.
- Subject to the fullest extent permitted by applicable law, ANTA shall not be liable for any indirect, incidental, special, punitive or consequential loss arising out of or in connection with the purchase or use of any Product, including loss of profit, loss of revenue, loss of opportunity or loss of data, except where such liability cannot be excluded by law.
- To the extent permitted by law, the Website and its content are provided on an “as is” and “as available” basis for general information purposes. ANTA does not guarantee that the Website will always be uninterrupted, secure, error-free, or free from viruses or other harmful components, although ANTA takes reasonable measures to maintain the Website and protect its systems.
- To the extent permitted by law, ANTA shall not be liable for any loss or damage arising from the Customer’s use of, inability to use, or reliance on the Website or any content made available through it, except to the extent such loss or damage results from ANTA’s wilful misconduct, fraud, or liability that cannot be excluded under applicable law.
- ANTA shall not be liable for any loss or damage caused by viruses, distributed denial-of-service attacks, or other technologically harmful material that may affect the Customer’s device, computer equipment, software, data or other material arising from use of the Website or from downloading any content from it or from any website linked to it, except to the extent such liability cannot be excluded under applicable law.
- The Website may contain links to third-party websites or resources for convenience only. Such links do not imply endorsement, approval or control by ANTA. ANTA is not responsible for the content, availability, security or privacy practices of any third-party website, and the Customer accesses such websites at his or her own risk.
- Data Privacy
ANTA complies with all applicable data privacy laws. For information on the use of data please refer to our Privacy Policy, which forms an integral part of these GTC. Customers should read and accept the Privacy Policy carefully before placing an order.
- Copyright
We hold the copyright to all images, films and texts published in our Webshop. Use of the images, films and texts is not permitted without our express consent.
- Events Beyond Our Reasonable Control
- ANTA shall not be liable for any failure or delay in performing any of its obligations under a Contract to the extent such failure or delay is caused by an event beyond ANTA’s reasonable control.
- An event beyond ANTA’s reasonable control includes, without limitation, acts of God, natural disasters, flood, storm, fire, explosion, earthquake, epidemic, pandemic, public health emergency, war, threat of war, armed conflict, terrorist attack or threat of terrorist attack, civil unrest, riot, labour disputes or industrial action by third parties, governmental action, sanctions, embargoes, import or export restrictions, interruption or failure of utilities, telecommunications or transport networks, unavailability of carriers, delays caused by customs or public authorities, or any other event or circumstance beyond ANTA’s reasonable control.
- If an event beyond ANTA’s reasonable control affects the performance of ANTA’s obligations under a Contract, ANTA will notify the Customer as soon as reasonably practicable. ANTA’s obligations shall be suspended for the duration of the relevant event, and the time for performance shall be extended accordingly.
- Where such event affects delivery of the Products, ANTA may arrange a revised delivery date or cancel the affected order, in whole or in part, by notifying the Customer.
- If such event continues for more than thirty (30) days from the date of the order and materially prevents performance of the Contract, either party may cancel the affected Contract by written notice. If the Contract is cancelled after payment has been made but before delivery is completed, ANTA will refund any amounts paid for the affected Products and any corresponding undelivered standard delivery charges, subject always to applicable law and these GTC.
- Customer Responsibility
- The Customer is responsible for ensuring that all information provided when placing an order, including the delivery address, contact details and payment information, is accurate and complete.
- The Customer shall use the Website and the Products only in compliance with applicable law and these GTC.
- The Customer shall be responsible for any loss or additional cost suffered by ANTA to the extent directly caused by the Customer’s material breach of these GTC, provision of inaccurate information, refusal to accept delivery without valid reason, or misuse of the Products, subject always to applicable law.
- Miscellaneous
- Assignment
ANTA may transfer or assign its rights and obligations under a Contract to any affiliate or other organisation, provided that this does not adversely affect the Customer’s rights under these GTC.
- No Third-Party Rights
This Contract is between the Customer and ANTA only. No person other than the Customer and ANTA shall have any right to enforce any of its terms, except that ANTA’s affiliates may rely on any provision of these GTC intended for their benefit.
- Severability
If any provision of these GTC is found by a court or competent authority to be invalid, illegal or unenforceable, that provision shall, to the extent required, be deemed severed, and the remaining provisions shall remain in full force and effect.
- No Waiver
If ANTA does not insist immediately that the Customer do anything required under these GTC, or if ANTA delays in taking steps against the Customer in respect of a breach, that will not mean that the Customer does not have to do those things, and it will not prevent ANTA from taking steps against the Customer at a later date.
- Entire Agreement
These GTC, together with any order confirmation, Privacy Policy, and any other policies expressly incorporated by reference, constitute the entire agreement between the Customer and ANTA in relation to the purchase of Products through the Website, except for any rights or remedies that cannot be excluded under applicable law.
- Governing Law and Jurisdiction
This GTC is governed by the federal laws of the UAE and the local laws and regulations of the Emirate of Dubai.
In the event of any dispute, controversy, or claim arising out of or relating to your purchase or these GTC, you agree to first contact ANTA Customer Service via email at [Email Address] or by calling [Phone Number]. Please provide your order number and a brief description of the issue. Upon receipt of your notification, both you and ANTA shall attempt in good faith to resolve the dispute through friendly discussions for a period of at least thirty (30) calendar days. Most concerns can be quickly resolved to the customer’s satisfaction through this process.
If the dispute is not resolved through amicable settlement within the 30-day period, you may refer the matter to the relevant local consumer protection authority for mediation and administrative resolution in accordance with the applicable law.
If the dispute remains unresolved following the mediation efforts by the relevant authorities, it shall be finally settled by the Dubai International Arbitration Centre (DIAC) under its simplified rules. The seat shall be Dubai, and the language English.
This process does not limit any mandatory consumer rights available under UAE law.
- Mandatory Consumer Rights
Nothing in these GTC shall limit, exclude or affect any mandatory rights that the Customer may have under applicable consumer protection law in the United Arab Emirates. In particular, where a Product is defective, unsafe, or not in conformity with the agreed specification or description, the Customer may have statutory rights to repair, replacement, return, refund, or other remedies in accordance with applicable law. UAE executive regulations expressly provide for recovery of defective goods, replacement or repair at the provider’s expense, or a full refund of the amount paid.
